Terms of Service

1. These terms, in plain language

These Terms of Service (“Terms”) are an agreement between you and Morrill Creative LLC, doing business as Kids Podcasts (“Kids Podcasts”, “we”, “us”), covering the kidspodcasts.com website, the Kids Podcasts mobile app, and everything they include — the podcast directory, playlists, child profiles, the Family Portal, and premium features (together, the “Service”). By using any part of the Service you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.

2. Who can use the Service

You must be 18 or older to create an account. Accounts, child profiles, approvals, and purchases are for parents and legal guardians acting on behalf of children in their care. The child-facing side of the app is intended for children to use only after a parent or guardian has set it up, and the website's browsing pages are meant for grown-ups choosing audio for their families.

3. Your account

We sign you in with a one-time code we email you — there is no password. You are responsible for keeping access to your email account and your devices secure, and for everything that happens under your account. Child-profile PINs are a convenience barrier inside the app, not a device-level security control. Tell us at hello@kidspodcasts.com if you believe your account has been used without your permission.

4. What Kids Podcasts is (and isn't)

Kids Podcasts is a curated directory and listening experience for children's podcasts. We organize shows, hand-build playlists, and give parents tools to approve what their kids hear. The child app shows only content you have approved — but it is a curated listening experience, not a device-level parental control. A child with full access to a device could uninstall or reinstall apps. For stronger enforcement, use your device's built-in controls (iOS Screen Time or Android Family Link) alongside this app.

Our curation is editorial judgment, not a guarantee. Please preview episodes yourself before approving them for your child — you know your child best, and you are the final judge of what is appropriate for your family.

5. Podcast content belongs to its creators

Every podcast in our directory is the property of its creator or publisher. All podcast audio streams directly from the publishers' own servers via their publicly available RSS feeds — we do not host audio files. Show names, artwork, and descriptions belong to their respective owners and are displayed the same way any podcast app displays them. Listing a show is not an endorsement of us by that show, or of that show by us.

We are not responsible for the content of third-party podcast feeds, and feeds can change or disappear at their owners' discretion. If you are a rights holder and would like your show updated or removed from our directory, email hello@kidspodcasts.com and we will act promptly.

6. Playlists and things you create

You can create playlists, name child profiles, and add notes. You own what you write. When you share a playlist — by link, with the community, or to a connected device — you give us permission to store, display, and transmit it so the feature works, including showing your chosen credit name if you submit a playlist for community publication.

Keep names and notes family-friendly. We may decline, edit the presentation of, or remove any shared content at our discretion, especially anything unlawful, hateful, deceptive, or inappropriate for an audience of parents and kids. Community submissions are reviewed before publication, and publication is not guaranteed.

7. Premium subscriptions and purchases

Some features are part of a paid premium offering purchased through Apple's App Store. Billing, renewal, cancellation, and refunds for those purchases are handled by Apple under Apple's terms: manage or cancel in your App Store subscription settings, and request refunds through Apple. Prices and included features may change over time; if we make a change that matters, we'll communicate it in the app. The free parts of the Service may also change, and we may add or retire features as the product evolves.

8. Connected services (like Yoto)

You can optionally connect third-party services — for example, linking a Yoto account to send playlists to a Yoto player. Those services have their own terms and privacy policies, which apply to your use of them. We only send content you explicitly choose to send, and you can disconnect a linked service at any time. We are not responsible for third-party services' availability or behavior.

9. Acceptable use

You agree not to:

• use the Service for anything unlawful, or in a way that harms children;
• scrape, bulk-download, or redistribute our directory, curation, or feeds beyond normal personal and family use;
• probe, overload, or circumvent our security measures, rate limits, or access controls, or use another person's account without permission;
• misrepresent an affiliation with us or with any podcast, or submit content you don't have the right to share;
• interfere with other families' use of the Service.

10. Our stuff

The Kids Podcasts name, site and app design, artwork, curation, playlists, and software are ours and protected by law. We give you a personal, non-transferable license to use the app and site for your family's use — nothing more is granted. If you send us feedback or ideas, you agree we can use them without obligation to you.

11. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied — including fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We don't warrant the accuracy or appropriateness of third-party podcast content, and we may change, suspend, or discontinue any part of the Service at any time. We will make reasonable efforts to tell you about significant changes.

12. Limits on our liability

To the fullest extent permitted by law, Kids Podcasts will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost data or profits, arising from your use of (or inability to use) the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim or fifty US dollars ($50). Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.

13. Your responsibility to us

If your misuse of the Service or violation of these Terms causes a third-party claim against us, you agree to indemnify us — that is, to cover the losses and reasonable costs that result.

14. Ending things

You can stop using the Service and delete your account at any time. We may suspend or terminate accounts that violate these Terms or endanger the Service or its users, and we may discontinue the Service itself. Sections that by their nature should survive (content ownership, disclaimers, liability limits) survive termination.

15. If you got the app from Apple

These Terms are between you and us, not Apple. Apple has no obligation to furnish maintenance or support for the app and is not responsible for addressing any claims relating to it (including product liability, regulatory, or IP claims). Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in an embargoed country and are not on any US government restricted-party list.

16. Changes to these Terms

We may update these Terms as the product evolves. The “last updated” date above will change, and for material changes we'll give notice on the site or in the app. Continuing to use the Service after a change means you accept the updated Terms.

17. Governing law

These Terms are governed by the laws of the State of New Jersey, where Morrill Creative LLC is organized, and applicable United States federal law, without regard to conflict-of-law rules. If any part of these Terms is found unenforceable, the rest remains in effect.
